Hỏi: Trường Đại học K thuá»™c Bá»™ Y có má»™t Tòa nhà làm việc. Tuy nhiên, đến nay, vẫn còn thừa phòng làm việc rá»™ng 50m2 ở tầng 1 nằm giáp vá»›i mặt phố nên Trường K muốn cho thuê phòng này để tránh lãng phí trong thời gian chÆ°a cần sá»­ dụng. Hỏi, Trường K có được cho thuê phòng làm việc này không? 

 

 

 

Theo quy định tại Điều 47 Luật quản lý, sá»­ dụng tài sản công thì Ä‘Æ¡n vị sá»± nghiệp công lập được cho thuê tài sản công trong các trường hợp sau tài sản được giao, được đầu tÆ° xây dá»±ng, mua sắm để thá»±c hiện nhiệm vụ Nhà nÆ°á»›c giao nhÆ°ng chÆ°a sá»­ dụng hết công suất.

Vì vậy, trong trường hợp này Trường K có thể cho thuê phòng làm việc còn chưa sử dụng. Tùy thuộc vào tính chất và giá trị tài sản cho thuê mà Bộ trưởng Bộ Y hoặc người đứng đầu đơn vị sự nghiệp công lập có thẩm quyền phê duyệt đề án cho thuê tài sản công tại đơn vị sự nghiệp công lập.
